Jeff Salazar, et al. v. Capital One Bank (USA), N.A., et al., Case No. 7:10-cv-00021 (D.S.C. Jan. 5, 2010), subsequently consolidated with eight other class action suits and added to Plaintiffs’ Fourth Amended Class Action Complaint in Kenneth Spinelli, et al. v. Capital One Bank (USA), N.A., et al., (8:08-cv-00132) (Dkt. No. 140) (M.D. Fl. Aug. 5, 2010). A nationwide settlement class was certified and Hughes Ellzey was not named as class counsel. However, attorney W. Craft Hughes was listed as “Additional Plaintiff’s Counsel” in the Settlement Agreement, and the work performed and time spent by attorney W. Craft Hughes was submitted simultaneously along with appointed class counsel for determination of loadstar and reimbursement of expenses. (See No. 145-1, Notice of Settlement, Exhibit 1, Aug. 13, 2010; and Dkt. No. 239, Order Granting Plaintiff’s Motion for Attorney’s Fees, Dec. 22, 2010)

Mary Ellen Wolf, et al. v. Wells Fargo Bank N.A., et al.; Cause No. 2011-36476 (151st District Court of Harris County, Texas) (filed June 19, 2011). A class was certified on May , 2013 and Hughes Ellzey was named as lead class counsel. This is a currently pending complex mortgage securitization fraud class action, during which Judge Engelhart found Hughes Ellzey “experienced and adequate counsel” and “will fairly and adequately represent the interests of the Class,” considering the work Hughes Ellzey, LLP has “performed in (i) identifying and investigating potential claims in this action, (ii) Class Counsels’ experience in handling class actions, other complex litigation, and claims of the type asserted in this action, (iii) Class Counsels’ knowledge of the applicable law, and (iv) the resources Class Counsel will commit to representing the Class.”

Gretchen Patch, et al. v. Millennium Products, Inc., Case No. BC448347 (Superior Court of California, Los Angeles County, Oct. 27, 2010). A class was certified and Hughes Ellzey was named as class counsel. In the order certifying the class, Hon. John Shepard Wiley stated Hughes Ellzey “has been appointed class counsel in other similar consumer class actions.” (April 3, 2012)

Diane Marie Alexander, et al. v. Discover Financial Services, Inc., et al., Case No. 7:10-cv-02754 (D.S.C. Oct. 22, 2010), subsequently transferred into an MDL styled In Re: Discover Payment Protection Plan Marketing and Sales Practice Litigation, Case no. 1:10-cv-06994 (N.D. Ill. March 8, 2011). A settlement class was certified in the MDL and Hughes Ellzey was not named as class counsel in the MDL

Matthew Robinson v. Paramount Equity Mortgage, LLC, Case No. 2:14-cv-02359 (E.D. Cal. Oct. 8, 2014). This is a currently pending TCPA class action. Hughes Ellzey recently negotiated a nationwide settlement and is currently awaiting the court’s ruling on the parties’ Joint Motion for Preliminary Approval. (See No. 16, Notice of Settlement) (E.D. Cal. Feb. 19, 2015)

Bryce Burton, et al. v. Chrysler Group, LLC, Case No. 8:10-cv-00201 (D.S.C. Jan. 27, 2010). A class was not certified in this case.

Mark W. Coerver v. Linktech Worldwide, Inc., Case No. 2:14-cv-07972 (C.D. Cal. Oct. 15, 2014). This case was settled on behalf of the individual plaintiff only, and dismissed with prejudice on December 4, 2014 (Dkt. No. 17). No class was ever certified in this matter.

Wade Gaines Kilpatrick, et al. v. Caribbean Cruise Line, Inc., et al., Case No. 0:14-cv-61572 (S.D. Fla. July 9, 2014). This is a currently pending TCPA which the trial court stayed pending the outcome of matter before the U.S. Supreme Court. No class has been certified yet.

Kevin J. Oliver, et al. v. DirecTV, LLC, Case No. 1:14-cv-07794 (N.D. Ill. Oct. 6, 2014). This case was settled on behalf of individual plaintiffs only, and dismissed with prejudice on July 9, 2015 (Dkt. No. 56). No class was ever certified in this matter.

Robert G. Olver, et al. v. Kaplan, Inc., et al., Case No. 1:15-cv-00549 (N.D. Ga. Feb. 24, 2015). This case was settled on behalf of individual plaintiff only, and dismissed with prejudice on February 2, 2016 (Dkt. No. 44). No class was ever certified in this matter.

John Colin Suttles, et al. v. Mutual of Omaha Ins. Co., et al., Case No. 1:14-cv-00752 (W.D. Tex. Aug. 11, 2014). This is a currently pending TCPA class action in the late stages of discovery. No class has been certified yet.

John Colin Suttles, et al. v. Specialty Graphics, Inc., Case No. 1:14-cv-00505 (W.D. Tex. May 30, 2014). The parties entered a class settlement. The court granted preliminary approval naming Hughes Ellzey as class counsel on February 23, 2016 [Dkt. No. 67].

Raymond S. Tolson, IV, et al. v. National Sports Services, Inc., et al., Case No. 1:14-cv-00442 (W.D. Tex. May 9, 2014). This case was settled on behalf of the individual plaintiff only, and dismissed with prejudice on May 18, 2015 (Dkt. No. 30). No class was ever certified in this matter.

Robin Alexander Williams, et al. v. Elephant Ins. Co., et al., Case No. 1:15-cv-00119 (E.D. Va. Jan. 30, 2015). This is a recently filed and currently pending TCPA class action. No class has been certified yet.

Benjamin Thomas, et al. v. Home Credit Corp., Inc., Case No. 11-cvs-1116 (General Court of Justice Superior Court Division, North Carolina, Vance County, Nov. 7, 2011). The parties entered a class settlement, which was approved and certified by the trial court.

Sven Wust, et al. v. Porsche Cars North America, Inc., Case No. 3:11-cv-01338 (N.D. Tex. June 17, 2011), subsequently transferred into an MDL styled In Re: Porsche Cars North America, Inc., Plastic Coolant Tubes Products Liability Litigation, MDL No. 2233 (S.D. Ohio July 5, 2011) (MDL Dkt. No. 44). A settlement class was certified and Hughes Ellzey was not named as class counsel in the MDL.
